Term of Service

Please read the following Terms of Service (hereinafter referred to as “Terms” or “Terms of use”) of Yes Taiwan (hereinafter referred to as “we” or “us” or “our” or “the service” or “this service” or “our service” or “the site” or “this site” or “our site”) carefully, as they (i) govern your access to and use of Yes Taiwan, (ii) affect your access to and use of the services that link to or reference these Terms, and (iii) contain important information about your legal rights, remedies, and obligations.

By accessing or using this site, you (hereinafter referred to as “your” or “user” or “users” or “Yes Taiwan’s users”) are agreeing to these Terms, and concluding a legally binding contract with Yes Taiwan — whether or not you become a registered user of Yes Taiwan.

If you are a minor, you need the consent of a legal representative such as a parent or legal guardian before accessing our platform. By using the Company’s related services and providing your personal information, you and your legal representative or guardian shall be deemed as having read and given consent to the terms laid out in our Terms of Use and Privacy Policy.

Scope and Modification of Terms

  1. The scope and application of our Terms shall include not only what is stipulated on this site, but also information sent by Yes Taiwan to users via email, and notifications via Social Media, etc.
  2. We may revise, change, or add new provisions to our Terms and Conditions without the consent of our users. The amended terms shall take effect from the time they are posted on this site, and users will be notified via email whenever these changes occur.
  3. If there are individual provisions (hereinafter referred to as “Individual Agreement”) between Yes Taiwan and its users, the provisions of the Individual Agreement shall take precedence over the Terms of Use. However, this shall not apply to the Privacy Policy.

Registration for this Service

  1. Users shall register information to use this Service by the means prescribed by us, and the information registered shall be the following information (hereinafter referred to as “Account”).
    • E-mail address
    • Nickname
    • Full name
    • Password
    • Microsoft Teams ID
    • If you are a minor, the name of your parent or guardian
  2. In registering for this service, you confirm and agree to the following items:
    • You read our Terms of Use carefully, and accept its contents.
    • You’ve registered your name, email address, password, Microsoft Teams ID, and other information truthfully and accurately.
    • You are responsible for keeping the information you have provided at the time of registration private.
    • You confirm that the environment you choose to attend class does not interfere with the use of this service.
    • The teacher who provides this service must be our employee.
    • We will be able to send e-mail notifications, advertisements, questionnaires, etc. to you regarding the Service. Additionally, to improve the quality of our customer support service, the contents of your inquiry will be recorded and stored.
    • Yes Taiwan and its teachers may monitor your lesson by recording or videotaping it for the purpose of improving the quality of the lesson.
    • You must pay the tuition fee according to the payment method specified by us.
  3. Your registration for the Service shall be completed upon notification of acceptance by Yes Taiwan via e-mail.
  4. We may refuse or cancel your registration if any of the following circumstances apply to you.
  • If you do not exist.
  • If there is any falsehood, misdescription, or omission in your registration information.
  • If your registration information has been deleted by us in the past.
  • If you have had any personal dealings outside the scope of your 1on1 course with the tutor.
  • If you try contacting the tutor for any purpose other than learning Chinese.
  • If you have registered for this service under a duplicate account.
  • If you are a minor, an adult ward, a person under curatorship, or a person under assistance, and you have not obtained the consent of your guardian or legal guardian at the time of registration.
  • If the applicant is or may be a member of a crime syndicate, a company affiliated with a crime syndicate, a corporate extortionist, or a person or group similar thereto.
  • Any other cases in which we judge that the user is unsuitable as a user of the Service.

Change of Registration Information

If you need to change your registered information, you must change it on the Yes Taiwan website without delay. To change your registration information, please contact us. Yes Taiwan is not liable for any disadvantages or other issues incurred by the user due to the user’s failure to change their registration information.

Use and Handling of Registration Information

  1. We shall properly handle the information that falls under the category of “personal information” among the information you registered, in accordance with our “Privacy Policy”.
  2. You shall manage your registered information strictly and not share it with others. The user who accesses an account must be the person registered to the account.
  3. You shall not allow any third party to use your account. You shall not transfer or lend your account to any third party.
  4. You shall be responsible for any loss or damage caused by your failure to keep track of your registration information, and we shall not be liable for any loss or damage caused by your failure to keep track of your registration information. If you find out that your registered information is being misused by someone else, you must immediately notify us and follow our instructions. You shall be obliged to compensate for all damages caused by the delay of the said contract.

Service Regulations

  1. This service uses the Internet and Internet telephone services (like Microsoft Teams) to provide Taiwanese Mandarin conversation lessons on the website. In order to use this service, a headset and a web camera are required. The headset and webcam shall be prepared by users.
  2. Users purchase points from this site and use the points to reserve lessons. PayPal is the international payment system for point purchases on Yes Taiwan.
  3. Points used by the user is non-refundable. Your refund can only be made through PayPal. The calculation of point refund is baced on the exchange rate on the date the user perchased points on paypal record. Read our [pricing guide] for additional information.PayPal is the only international payment system that can be used for refunds, and the user is responsible for PayPal’s handling and processing fees. If the user purchased their points through a bank remittance in Taiwan, we will refund the amount of the points through the bank in Taiwan, in which the handling fee will also be covered by the user when applicable.In addition, for users who request a refund for currency conversion, whether it is USD to TWD or TWD to USD, the exchange rate will be calculated on the date we receive the refund request from the user.
  4. To provide consistent service to users, we will record information obtained during the lessons.
  5. The information obtained in the preceding paragraph may include personal information of the user.
  6. The information we obtain during lessons will be used only for the purpose of providing better services to the user.
  7. We will take days off during Taiwanese national holidays (Dragon Boat Festival, Mid-Autumn Festival, Spring Festival, etc.) and year-end and New Year holidays. However, each teacher will make the final decision whether or not to take days off on the aforementioned holidays. In addition, the service may change the date of days off with a notice on this website without prior notice to users.
  8. Reservations for lessons can be made up to 3 hours before the lesson starts. Lesson cancellations are allowed up to 3 hours prior to class. After a lesson is successfully canceled, the points will be returned and the lesson can be reserved again.You can cancel a lesson up to 3 hours before the lesson starts. However, the number of times you can cancel your lessons in a day is limited to 5 times. If you are late or your computer is not working properly, the teacher will wait for 10 minutes after the lesson starts. 10 minutes after that, the lesson will be considered an absence.
  9. If the teacher is unable to provide the service due to individual circumstances on his/her part (e.g. technological failure, poor health, etc.) after the lesson has started, the reservation will be canceled and the original points will be returned.
  10. Please note that if a student is unable to take the lesson due to reasons not caused by the teacher (natural disasters, communication problems, etc.), the points will not be refunded.
  11. You will receive a notification your reservation is made via email after you have reserved your lesson. Please use the teacher’s Microsoft Teams ID written in this email and contact the teacher before the lesson to let the teacher know which part of the material you would like to learn. It takes time to prepare for a lesson — if you do not specify what you want to learn before the lesson, the lesson will be free talk.

Prohibited Acts

1. In using the services provided by us, Users shall not engage in any of the following acts, or any act that may lead to such acts.

  • Transferring, using, or selling the right to use the Service to the third party.
  • Actions that attempt to damage or defame the reputation or credibility of the Service or Yes Taiwan with malicious intent. (*Actions such as posting negative information about the Service, Yes Taiwan, or Yes Taiwan’s affiliates on social media or blogs are examples of such actions. However, this does not apply to review acts that are deemed to be objective. If you have any questions regarding this point, please contact us in advance).
  • Any act that violates the laws of Taiwan or that poses a threat to our ability to operate our business.
  • Any act that transmits the personal information or privacy of Yes Taiwan’s staff over the Internet.
  • Any act that is obscene or abusive to Yes Taiwan’s staff members.
  • Registering false information.
  • Interfering with the operation of this service. (*Some specific examples are listed below. Intentionally overloading the website operated by us. Reserving a large number of lessons at once and repeatedly canceling lessons just before the lesson. Repeatedly and intentionally making unnecessary inquiries to our customer service).
  • Abusive language to customer support staff.
  • Interfering with the customer support staff or interfering with customer support operations.
  • Transmitting your communications with our customer support staff over the Internet. (*In the past, a number of people have worked together to repeat unnecessary inquiries to our customer support intentionally in order to harass the customer support staff. We have identified such cases as acts that interfere with customer support operations.)
  • Registering or using the Service for purposes other than learning Chinese. (*Whether you are registering or using the service for purposes other than Chinese language learning is subject to Yes Taiwan’s judgment. In the past, even if a registrant paid the tuition, we may have judged it as intentional harassment and suspended his/her use of the service).
  • Contacting teachers for purposes other than learning Chinese. (*Specifically, this includes trying to get close to the teacher in private, headhunting the teacher, discussing with the teacher to learn Chinese under a private contract, or asking for information unrelated to learning Chinese).
  • Recording, videotaping, or photographing (screenshotting or screen capturing) the lesson without the teacher’s consent.
  • If you are an operator of a competitor, a teacher of a competitor, or a collaborator of such a competitor (*online or offline language school).
  • Harassment of teachers. (*The certification of harassment will be made at the discretion of Yes Taiwan after confirming the facts.)
  • Entering into an individual contract with a teacher and taking lessons without our consent.
  • Investigating or transmitting information about the operator, tutors, or related parties that are not disclosed by Yes Taiwan on its website. (personal information, career, ability, employment conditions, human relations, conversation history, photos or articles published outside of the Yes Taiwan’s website, etc.)
  • Using an account with more than one person.
  • Sharing the Chinese learning materials sold by us with multiple users.
  • Imitating or reproducing the Chinese learning materials sold by us.
  • Reproducing articles, audio or video clips of free Chinese learning materials on Social Media without permission. (* However, this does not apply to the act of introducing the contents of a website by posting a link to it.)
  • Causing disadvantages or damages to other members, Yes Taiwan, or third parties.
  • Any other action that we deem inappropriate.

2. If you commit any of the acts specified in the preceding list, we shall delete your registration. Additionally, if we suffer any damages, we shall make a claim for those damages and take any other necessary legal actions against you. The liability for damages caused by the above-mentioned acts shall remain in effect even after the cancelation of your registration.

Withdrawal from membership

  1. Users may withdraw from membership at any time. If you wish to cancel your membership, please contact the operator. Upon request, we will delete your membership information and all class attendance records from our database. Please note that once your user information is deleted, we won’t be able to retrieve any information related to the courses you took or to any attendance records on the platform.
  2. The following information is not included in the information that we will erase after the user’s withdrawal.
  • Information sent or received by us and related parties via e-mail, Microsoft Teams, Zoom, social media, etc.
  • Reviews and comments you have posted on our website.

Suspension or Termination of Service

In the event of an emergency suspension of the Platform as described below, we will first temporarily suspend the operation of the Platform and inform users on the Platform or contact them by email. In addition, we reserve the right to suspend the Service, in whole or in part, for the following reasons:

  • When the Service cannot be provided due to natural disasters, fire, power outages, or other emergencies.
  • When the Service cannot be provided due to war, civil war, riot, labor disputes, etc.
  • In any other cases where temporary suspension of the Service is required by us for operational reasons.

Information Distribution

We may send notifications, advertisements, questionnaires, etc. to users by email, social media direct messages, or Microsoft Teams.

Limitation of Liability

1. Users agree that we shall not be liable for any and all damages arising out of or in connection with

  • Using the service or inability to use the service. (*Specifics are listed below. Failure to pass a Chinese language examination, entrance examination, etc. Failure to complete Chinese homework, etc.)
  • Unauthorized access to or unauthorized alteration of data transmitted by Users.
  • Information transmitted by other users of the Service.
  • The effect of learning Chinese through this service.
  • Any and all damages caused by the information transmitted by user during the lesson.
  • Any interruption of this service due to domestic or international political situations, natural disasters, or any other reasons for which Yes Taiwan is not responsible.
  • If you are unable to use this service satisfactorily due to any of the following circumstances:
    • The number of available lessons is temporarily insufficient due to either a sudden influx of students or a communication failure in Taiwan.
    • Unable to reserve the lesson at the time users want to take.
    • Unable to reserve the lesson of a specific teacher.
    • Situation in which lessons have to be canceled due to power outage or communication failure in Taiwan.

2. The primary means of communication from Yes Taiwan regarding their service shall be via email, social media channels, or Microsoft Teams, and users shall receive and confirm messages from Yes Taiwan. We are not obligated to compensate for any disadvantages to the user caused by the user’s failure to confirm their use of our service on these channels.

3. We are not obligated to compensate for any damages caused by computer viruses when using this service, and any damage caused by software used for this service and delivery files.

Copyright and Ownership

1. All copyrights and proprietary rights about the trademarks and logos related to this service belong to Yes Taiwan. Any unauthorized use of them by users is prohibited.

2. All ownership of the content you input and edit in this service belongs to Yes Taiwan. (*This specifically refers to comments and reviews posted by you.)

3. The copyright of the teaching materials that we sell for a fee belongs to Yes Taiwan. You must observe the following restrictions set by us.

  • The materials the user purchased may be used only by the user. You may not allow anyone other than yourself to view or use the electronic data of the purchased materials, or any reproduction of the materials (even printed copies on paper are considered reproductions).
  • You may not allow anyone other than the user to view or use the purchased materials, except when you allow your teacher to view the materials for use in lessons.
  • The user may not modify the purchased materials. The reason for this provision is to prevent you from imitating the purchased materials and presenting them as your own work or product, whether paid or unpaid. (* However, this provision does not apply if the alteration is solely for the purpose of learning Chinese. Even if you have modified the materials for the purpose of learning Chinese, you may not allow anyone other than yourself to view or use them outside of the lessons provided by Yes Taiwan).

4. The user may not reproduce any article, audio file, or video related to Chinese language learning that we have posted on this website or social media. However, if you introduce a link to the information that we send out, it is not considered as reprinting or reproduction. Captures or screenshots of the articles, audio, and videos we publish or provide are not allowed to be redistributed by the user.

Governing Law and Court of Exclusive Jurisdiction

This Terms of Use shall be governed by and construed in accordance with the laws of Taiwan. In addition, all disputes regarding the use of the Service shall be brought in the courts of Taiwan.
